PRACTICAL GUIDE OF HOW TO LEGALLY ENTER THE EU IF YOUR ARE FLEEING FROM UKRAINE
(particularly to Spain or Belgium):
If you are a Ukrainian national escaping from war in the European Union, these are your possibilities. We have collected the alternatives that both the EU as a supranational power, Spain and Belgium as a national power offer. Here you have a summary of the information you may need, and the links to access more details.

This Directive is established in Spain and in Belgium in the same terms.
- It provides a temporary protection that applies to displaced persons who have had to leave Ukraine because of the armed conflict since 24 February 2022 and who are unable to return in safe and durable conditions.
- Ukrainian nationals and their family members
- Stateless persons and third-country nationals enjoying equivalent international/national protection in Ukraine, and their family members.
(These categories can be expanded by the member states, as Spain did).
- Protection includes: Residence rights, access to the labour market, access to housing, social welfare assistance, medical or other assistance and means of subsistence. Basically, as if they had EU citizen status. These rights can only be enjoyed in the country where the temporary protection has been issued.
- The people who ask for the temporary protection are also eligible for international protection and enjoy the rights it establishes.
- For how long? It is similar to refugee protection in an EU country for one year, renewable, by six monthly periods for a maximum of one year, and another year if the causes that justify the temporal protection persist.
- Who is the responsible to issue this temporary protection? The member state that the applicant chose to be in.
The country has expanded the category of people who can enjoy this temporary protection to:
- Ukrainian nationals that were staying in Spain before the 24th of February 2022 and can’t go back to Ukraine because of the conflict.
- Third countries nationals that legally resided in Ukraine on the basis of a legal residence permit and can’t go back to their country or region.
- Family members of the later categories.
- Ukrainian nationals that were in Spain and had an irregular status before the 24th of February and can’t go back to Ukraine because of the conflict.
*You can also use Renfe trains in Spain free of charge if you are fleeing from Ukraine.

If you are a Ukrainian national and you are not covered by this protection, you can request the international protection status in the country you are in.
Spanish procedure to request the temporary protection
- How to start? the interested person should present a request through a declaration in person at Civil Workers of the Directorate General of Police, in the reception, reception and referral centres of the Ministry of Inclusion, Social Security and Migration, or, where appropriate, the police stations to be determined.
- What info are they going to request?
- Supporting documentation that prove you are part an eligible category.
- Domicile, phone number and email (when possible).
- Maximum period to decide on the request: 24h (urgent procedure). It will be notified by electronically.
International protection status
Once you got the temporary protection status you can also request the international protection (both regimes are compatible) , from which you could benefit from some advantages:
- Not subject to the terms of temporary protection.
- More extensive regime of rights.
- Indefinite term of the protection.
The same member state that proceeded the temporary protection will be the one that will decide on the international protection as well.
There are 2 situations you can opt to: refugee (asylum) status and subsidiary protection. The refugee status is the top level of international protection and the subsidiary protection is the second level of international protection. The personal circumstances of the person that is requesting it will predetermine the status they can request.
- How to start? make a claim pointing out the will to access to international protection by a declaration in person of the applicant or through a representative and present it in the National Police Stations authorized, the Aliens Office and Asylum Offices and Refuge. It will follow a personal interview with the applicant.
- When to present it? In the maximum period of 1 month since entering the territory.
- Which rights would you benefit from? If you are eligible for the international protection status you will have recognized the rights established in the 1951 Geneva Refugee Convention.

How can you enter in Belgium? All Ukrainian people are allowed to enter Belgium with a valid biometric passport, without visa or additional documents. The citizens that do not have a valid biometric passport, but that have received a visa for Belgium instead, can also obtain an extension of their authorized stay up to a maximum of 180 days.
*Also, if you are fleeing from Ukraine you can use SNCB/NMBS trains free of charge.
Possible stays:
– Temporary protection: Ukrainian people can present themselves with their identity documents at the registration center (Boulevard de Waterloo 121, 1000 Brussels), to apply for temporary protection. This only applies forUkrainians residing in Ukraine as well as to third country nationals or stateless persons enjoying protection in Ukraine and their family members. They need (1) to come in person and (2) bring their identity documents. A temporary protection certificate is issued if the conditions are met and with this document the municipal administration of their place of residence can issue a A card that is valid for one year and can be extended up to three years.
– Short stay (up to 90 days): Ukrainian people with a valid biometric passport don’t need a visa in order to be able to stay for 90 days in Belgium and can reside legally in our country during this period, and therefore don’t have to apply for asylum.
It is recommended for the Ukrainians to report the municipality once they have arrived in Belgium and provided the details of their staying, in order to obtain a declaration of arrival valid for 90 days. However, during a short stay, the Ukrainians are not allowed to work, they do not have social support and they don’t joint the public health insurance system.
The documents needed to apply for a short stay are:
- Copy of the passport (valid for at least 3 months after the application in Belgium)
- A copy of the declaration of arrival
- Prove that you have travel insurance that cover necessary medical expenses.
– Extension of the short stay: The 90-days period can be extended up to a maximum of 180 days if the situation in Ukraine does not allow for a safe return at the end of the 90 days. The Ukrainians must in that case (1) ask the municipality of their residence to extend their short stay and (2) prove that they have travel medical insurance valid for the duration of their stay in Belgium.
The Belgian immigration office stresses that the Ukrainian citizens that are or have legally arrived in Belgium should not worry if they stay longer that the authorized stay, due to the situation in their country.
Conditions for Ukrainian people to work in Belgium:
- Ukrainians applying for the short stay (90 days) are NOT allowed to work in Belgium.
- Ukrainians requesting the temporary protection ARE able to work in Belgium.
